This site is operated as a French one-person company, similar to a sole proprietorship structure, by the owner "Laurent DUBOSQ", who also acts as data controller and director of publication, with headquarters at 49, RUE NATIONALE, 78520 LIMAY, FRANCE, e-mail: laurent.dubosq.business@gmail.com.
Our business has been registered with the Trade and Companies Register of VERSAILLES (FRANCE) under the number 831 467 956. As a company using the declaration regime "Micro" orders are exempt from VAT.

PREAMBLE
The present General Conditions of Sale apply to all orders placed with the company Awakning Jewelry for all items proposed on the site www.awakningjewelry.com by natural persons, not by legal persons. Consequently, the fact for any person to order a product proposed for sale on the Internet site of Awakning Jewelry implies the full and complete acceptance of the present General Conditions of Sale that the Customer acknowledges having known before his order.
Awakning Jewelry reserves the right to modify this document at any time. However, the General Conditions of Sale applicable to the order placed by a Customer on the Awakning Jewelry Website are those accepted by the Customer at the time of the order.
According to the French legislation in force, our General Conditions of Sale are the sole basis of commercial negotiation with our Customers. In the absence of a written agreement, any order received implies the unconditional acceptance of our General Conditions of Sale, notwithstanding any clause to the contrary that may appear with the Customer's order.
The fact that Awakning Jewelry does not refer at any given time to one or more provisions of the general conditions of sale cannot be interpreted as a waiver and Awakning remains at all times free to demand their strict application.
ARTICLE 1 : INTEGRITY & OBJECT
The present General Conditions have the purpose of defining the rights and the obligations of the different parties in the framework of the online sale of goods proposed by Awakning Jewelry to its Customers, from the order to the delivery, passing through the payment and the respect of the guarantees. Awakning Jewelry is careful to comply with the French laws, the European laws, the recommendations of the International Chamber of Commerce (ICC) including their conditions of international trade (Incoterms) in their latest version, the GDPR & CCPA.
The Customer is deemed to accept without reservation all the provisions of these General Conditions.
ARTICLE 2 : SCOPE OF APPLICATION
The present Terms and Conditions of Sale regulate the sale of the products on the day of the order placed by the Customer through the Awakning website ("https://www.awakningjewelry.com").
ARTICLE 3 : OUR ACTIVITY
Our business is the sale of jewelry under our brand name "Awakning".
Our mission is to enable people living in our modern Western societies to draw on the energy of the spiritual values they share with Eastern philosophies to affirm themselves and find well-being and harmony.
The values we associate with our brand and our ability to express the values and teachings of Eastern philosophies through our selection of jewelry represent our added value, justify the price, allow us to maintain our business, offer new products and introduce our brand to new people.
ARTICLE 4 : PRODUCT INFORMATION
4.1 PRODUCT AVAILABILITY
Awakning Jewelry agrees to deliver orders received only to the extent of the product stock available in the warehouse or to the extent of the stock available at its suppliers. In the absence of availability of a product, Awakning Jewelry reserves a delay of an additional 48 hours (2 business days) to process the order with its suppliers. This delay may affect the estimated delivery date and may extend it by one or two days.
If Awakning Jewelry cannot obtain a product ordered from its suppliers, the company will notify the Customer by email to cancel the order and will process a full refund of the payment as soon as possible, within 14 days.
4.2 NOTICE OF UNAVAILABILITY
The unavailability of a product is mentioned on the product page with the mention "sold out".
4.3 AGE REQUIRED TO USE THE PRODUCTS
Our products are intended to be worn by people who are of sufficient age to have an appetite for personal development and well-being as expressed by Eastern philosophies. This age cannot be fixedly defined, it depends on each individual's maturity and needs. However, for safety reasons, we strongly advise against our products being entrusted to or worn by children or infants. Awakning Jewelry will not be responsible for any incident related to their use of our products.
ARTICLE 5 : PRODUCT PRICE & TOTAL ORDER AMOUNT
5.1 PRODUCT PRICE
Any price attached to a product is shown as a price per unit.
5.2 CURRENCY
Prices are quoted in U.S. Dollar.
5.3 SPECIAL OFFERS
We offer private sales of our products accessible via email to our newsletter subscribers and from our website in a private area to people who have created an Awakning account and log on to https://www.awakningjewelry.com/collections/private-promotions.
We offer promotions every two weeks with a validity period of 14 days. Sometimes we can organize periodic events such as promotions adapted to calendar events (Mother's Day, Christmas, etc.) or organize unplanned operations such as private sales. The duration of our promotions can vary from 2 weeks to 2 months depending on the event.
All of our promotions receive one or more visible marketing offers with their validity periods. Discounts are variable depending on the product and the event, but are limited by the ceiling set by French law that prohibits us from selling at a loss - Article L.442-5 of the French Commercial Code.
Some promotions may be reserved and shared with specific Customers, based on the interest they may have in Awakning Jewelry.
Please note that we only accept one promotional code per order. Our codes are subject to change and are not provided upon request. Each of our codes has an expiration date communicated to Customers, and we cannot honor if promo codes have expired. We are not currently affiliated with any third-party coupon sites, so if our Customers can find codes there, they will be illegal and will not work.
5.4 VAT
Being a French sole proprietor using the "micro" declaration scheme, orders are exempt from VAT, even for international orders.
5.5 DELIVERY COSTS
Each order is automatically charged a basic amount for delivery. More information on delivery costs in the article "8.3 Shipping Cost".
5.6 OPTIONAL FEE
Any ordering options, such as a faster delivery method, will be at the expense of the Customer.
5.7 TOTAL AMOUNT
After the Customer has clicked on the "CHECK OUT" button in the Cart, the total amount will be shown at each step of the "Check Out" sales tunnel. The payment required from the Customer corresponds to the total amount of the purchase, once the points mentioned above have been processed.
5.8 EVOLUTION OF PRICES, TAXES & CONTRIBUTIONS
Since the prices charged by the suppliers of Awakning Jewelry are constantly evolving, the prices published on the site are also likely to be constantly modified. However, the prices cannot be modified once the Customer has placed an order.
Likewise, if one or more taxes or fees are suddenly created or changed, either up or down, such change may be reflected for future orders by a change in the selling prices of the products and may be displayed in the "Check Out" sales tunnel.
ARTICLE 6 : ORDER
6.1 ABILITY TO CONCLUDE THE CONTRACT
The Customer interested in an article visible on the site www.awakningjewelry.com can order directly through this same site.
The Customer can place his order there 24 hours a day, 7 days a week.
Each Customer of Awakning Jewelry declares to have the capacity to enter into a contract under the conditions described below, i.e. to be an emancipated minor or to have reached the age of majority and not to be protected within the meaning of article 488 of the French civil code.
6.2 ACCEPTANCE OF CONDITIONS & COMMITMENT
Every order implies acceptance of the prices and description of the products available for sale.
During the buying process, the Customer has to ensure that he/she has read, understood and consent to our Terms and Conditions of Sale and our Privacy Policy by ticking the box "I agree to the terms and conditions of sale and the privacy policy" in the cart. This mention is provided with the necessary links required to access the mentioned policies in force.
In any case, the online provision of the bank card number and the final validation of the order by the Customer will constitute proof of the order and the current liability of the amounts for the products selected in the order. This validation constitutes an irrevocable acceptance of all operations carried out on the site www.awakningjewelry.com.
6.3 RIGHT TO MAKE A MISTAKE
Each Customer has a period of 30 minutes after placing his order to request a change by contacting expressly Awakning Jewelry from the contact page or directly by email to contact@awakningjewelry.com. Beyond this period, Awakning Jewelry may attempt to have the erroneous information corrected but with no guarantee that it will be taken into account in time by its supplier.
6.4 SUBMISSION LANGUAGES
Orders are submitted to Awakning Jewelry in English. French may also be used by Customers when contacting us, if they wish.
6.5 RIGHT OF REFUSAL
Awakning Jewelry enterprise reserves the right to suspend processing and delivery in case of refusal of authorization for payment by bank card by officially accredited bodies or in case of non-payment according to article 121-11 of the French consumer code. Awakning Jewelry Enterprise reserves in particular the right to refuse the processing and delivery of an order placed by a Customer with whom a payment dispute has not yet been resolved or to become aware of any excessive inconvenience related to the delivery or the legislation in force in the country concerned.
6.6 IDENTITY CHECK PROCEDURE
As part of an order control procedure aimed at ensuring that no one uses another person's bank details without their knowledge, the Customer may be asked to send proof of identity and/or residence by e-mail to the company Awakning Jewelry. The order will only be confirmed after our services have received and verified the data sent. In case of non-receipt of these elements or in case of doubts about their authenticity at the end of the 14 days following the order, the order will be cancelled and the amount paid will be refunded within 14 days.
6.7 ORDER CONFIRMATION
An email is automatically sent to the Customer to confirm the order, provided that the email address indicated on the registration form does not contain an error. The Customer must verify the completeness and conformity of the information it provides and the content of the order. Awakning Jewelry cannot be held responsible for any errors in data-entry and the consequences in terms of delay or error in delivery. If the order could not be delivered or retrieved, all costs incurred will be charged to the customer.

6.8 ORDER & TRANSFER OF PROPERTY
Once the order is confirmed, Awakning Jewelry becomes responsible for the performance of the contract. The company remains the owner of the entire product(s) submitted for the order, until delivery to the address specified by the Customer and all goods have been paid for.
6.9 ORDER STATUS
The Customer can at any moment check the status of its order since his account interface by clicking here, or at the address "https://www.awakningjewelry.com/account", or by clicking on the human icon on the top right of the screen for a desktop display, or on the menu icon then "Log in" for a smartphone/tablet display. This order tracking allows the Customer to know the processing phase of his order, but also the sending or delivery phase of his parcel(s).
More information about the tracking of parcels can be found in the article "8.6 Delivery Tracking".
6.10 PROOF OF ORDER & RECEIPT
Computerized records, stored in Awakning Jewelry's servers under reasonable conditions of security, shall be considered as evidence of communications, orders and payments that have taken place between the parties.
Storage of purchase orders and receipts is done on a reliable and durable medium that can be produced as evidence.
The Customer has, both in the Order Confirmation and Shipping emails, the link to download in PDF format, the original receipt of his order. Note that the receipt does not come with the package. The purchase order that Customer creates online or the order confirmation emailed to Customer by Awakning Jewelry does not constitute a receipt. Only the receipt is authentic.
Awakning Jewelry maintains an electronic example of each receipt. In addition, it is possible for Customers to contact the Customer service to obtain any of their receipts.
6.11 PROCEDURE TO PLACE AN ORDER (Help for Customers)
To help the Customer to place an order, we have written a simple procedure to follow using a credit card:- Choose from the product pages the different items you are interested in and then click on the "Add to Cart" button if you intend to purchase them.
- Once you have made your selection, go to your cart by clicking on the cart at the top right of the screen. In this cart page, you have the possibility to view, modify, cancel or validate your cart. Once you have validated your cart, you will need to check the box in front of "I agree to the terms and conditions of sale and the privacy policy" if you agree and click on the "Check Out" button to enter the Check Out sales funnel.
- Once in the funnel, at the information step, simply enter the necessary data for an order, i.e. your email address and your delivery address. Then, validate this step by clicking on the "Continue to Shipping" button.
- Once in the Shipping step, you will have to choose your shipping method, by default "Standard + Tracking", then click on "Continue to Payment".
- Once in the Payment stage, select "Credit Card" and enter your credit card information, then click the "Review Order" button.
- Once on the order review page, check one last time that all order information is correct. If not, click on the word "Change" at the end of the line of incorrect information, correct it, and validate each step until you return to this page. If you agree with all the information on the "Review Order" page, click on the "Pay Now" button to proceed with the payment of your order. This payment will be made through a secure server and will definitely formalize the sales contract with Awakning Jewelry. Please note that by clicking the "Pay Now" button, you are stating that you agree to pay for this order.
- Wait for your jewelry to arrive, then take the opportunity to express your deepest values.
ARTICLE 7 : PAYMENT
7.1 MEANS OF PAYMENT
The Customer can pay his order online by: Visa, MasterCard, American Express or Apple Pay by our Stripe partner or by using the Paypal service.
The Customer guarantees to the Awakning Jewelry enterprise that he/she has the necessary authorization to use the chosen payment method.
7.2 PAYMENT BY DEBIT
The charge for purchases on the Customer's account is made at the time of processing the order.
7.3 SECURE PAYMENT
Awakning Jewelry uses all necessary means to ensure the security and confidentiality of data transmitted online. To this end, the site uses a secure mode of payment SSL (Secure Socket Layer) that allows the encryption of the Customer's bank details during their transmission over the Internet. You can see that the transmission is encrypted by the software by the padlock symbol that appears in the web browser.
The transaction is carried out through the services of Stripe or Paypal, which themselves receive the encrypted banking information provided on the site at the time of payment.
Payment information including credit card numbers or paypal ID are both protected by encryption. This information is also salts and hashes using BCRYPT. Data storage is secure and compliant with PCI-DSS, ISO 27001 and TIER III certifications.
7.4 AWAKNING'S BANK ACCOUNT
The total amount will be centralized in Awakning's bank account opened at the online bank BOURSORAMA, owned by the French bank "Société Générale".
ARTICLE 8 : DELIVERY
8.1 DELIVERY SERVICES
The products are delivered to the address indicated by the Customer on the purchase order. The Customer must verify the completeness and conformity of the information he or she provides to Awakning Jewelry. The latter cannot be held responsible for any possible errors in data entry and the consequences in terms of delay or delivery error. If the order could not be delivered or retrieved, all costs incurred will be charged to the customer.
8.2 DELIVERY ZONES
The geographical delivery zones for Awakning Jewelry's items are as follows:

- United Kingdom
- Australia
- South Africa
- Rest of the world (subject to validation by the company)
Countries open for delivery are displayed on each product page under the "Delivery" tab.
The Customer should contact the Awakning Jewelry's Customer service department for accurate delivery information to a specific country/world territory other than those mentioned above, before attempting to order.
Please note that although we ship internationally, we may not be able to ship to certain countries due to logistical reasons.
8.3 SHIPPING COST
All of our orders include basic shipping charges, the cost varies by country. The exact shipping cost is mentioned on each product page under the "Delivery" tab and then throughout the "Check Out" sales tunnel. Awakning limits shipping charges to a maximum of $4 to make products affordable for all budgets. Any exceeding of these charges will be the responsibility of the company.
However, if Awakning only has carriers that offer prohibitive prices, the company reserves the right to refuse any order.
Under certain conditions, delivery charges may be subject to commercial offers. To once again facilitate access to our products, the company has decided to offer free shipping worldwide on any order of $40 or more. The Customer will automatically benefit from the offer and will not have to do anything to take advantage of it.
In specific cases such as ordering the wrong size multiple times, ordering the wrong model, etc., the Customer will be responsible for the costs associated with reshipping. More information in the article 9.10 Extension to exchange.
8.4 DELIVERY TIMES
The estimated delivery time for a product is displayed on its product page, in the shopping cart, and on the order thank you page. It will also be clearly mentioned in the order confirmation and shipping emails, the latter could even refine the times.
The estimated delivery times mentioned on the site are those which are usually experienced.
Awakning Jewelry, according to French law, guarantees a maximum delivery within 30 days for the countries mentioned in the article 8.2 Delivery Zones from the day of the order, with the exception of South Africa.
If the package has not been delivered on time, the Customer can find more information in article 8.9 Exceeding the Delivery Time.
For countries other than those mentioned in the article on delivery zones (8.2), the delivery can be extended and specific to each country. For this reason, the Customer must contact Awakning Jewelry to ensure that Awakning is able to deliver its products easily before ordering.
Note: Depending on the country, public vacations and any national vacations may extend the estimated delivery period. These events are therefore not included in the estimated delivery period communicated during the purchase process by Awakning Jewelry and must be taken into account by our Customers through these Terms and conditions of Sale.
8.5 PROCESSING TIMES
Each order will incur a processing time, will be fully inspected, packaged and delivered to the carrier with a delay of 24 to 72 hours. The processing time is automatically included in the estimated delivery time communicated on our website and through our emails sent prior to the shipping email.
In the case of an order that may include one or more products, Awakning Jewelry may ship the order in multiple packages at its own expense.
Products are packaged to comply with current transportation regulations, and to ensure optimal protection of the products during their delivery.
Then, an email is automatically sent to the Customer when the products are shipped. With this e-mail, the Customer can consider a more precise delivery period.
8.6 DELIVERY TRACKING
For all our orders, each parcel receives a tracking number just before it leaves for transit. The tracking number will be taken into account in the dispatch email sent to the Customer, allowing this latter to track its parcel.
Customers can track their package(s) from :
- The shipment confirmation email where the Customer can click on "Track your shipment" by clicking then on the "Track" button corresponding to his order or by clicking on the "View your order" button, then on the tracking number displayed.
- The Customer account interface directly by clicking here (https://www.awakningjewelry.com/account) then the "Track" button corresponding to its order.
- The tracking page whose link is displayed in the footer of the website or by clicking here (https://www.awakningjewelry.com/apps/trackorder) then by informing its tracking code or its order number with email address and clicking on the "Track My Order" button.
8.7 TAXES & CUSTOMS FEES
In rare cases, these orders are subject to possible taxes and customs fees according to the country of delivery. For all our sales, the transfer of costs and risks will take place according to the DAP Incoterm in the latest version of the ICC in effect at the time the payment of the order is made. DAP is the most widely used method of managing the international delivery relationship from merchant to Customer. To summarize the DAP method, Awakning is responsible up to the delivery of the order to the address given by the Customer at the time of order, while the Customer is responsible for taking possession of the goods, and may have to bear any customs charges.
We recommend our Customers to check with the customs authorities of their country to find out if they have to pay customs fees and the approximate amount before validating their order.
Note : US Customers are exempt from taxes and import duties under $800 since President Barack Obama amended the TFTEA in 2015 Feb 24.
8.8 DAMAGED PARCELS / DAMAGED ITEMS
Awakning Jewelry reminds that it is the Customer's responsibility to inspect his parcels and item(s) upon reception. In the case of any damage to the item(s), the Customer is ask to expressly notify Awakning Jewelry by email at contact@awakningjewelry.com and to send us photo(s)/video(s) of the damaged product, of the box and the package to allow us to investigate the causes of the deterioration. Thus, the buyer may request a replacement at our expense of the damaged product within 30 days after delivery of the order (60 days during the Christmas period).
8.9 EXCEEDING THE DELIVERY TIME
If it happens that initial delivery times cannot be met, the Customer may contact Awakning Jewelry to request a search of the parcel. Awakning Jewelry remains responsible to deliver the order during an additional period similar to the initial delivery times. This additionnal period allows to Awakning Jewelry to retrieve the parcel and have it delivered to the Customer or to send another order at the company's expense. If the parcel still not delivered to the end of the second period, the Customer can cancel the order and ask for a total refund.
Note : If any package is received by the Customer in duplicate or after the refund of the order, we ask our Customer to send it back accompanied by the proof of the return costs advanced by the customer by sending it to us by email so that we can refund them.
ARTICLE 9 : MONEY BACK GUARANTEE / RIGHT OF WITHDRAWAL (Return & refund Policy)
9.1 LEGAL RIGHT OF WITHDRAWAL
In accordance with the advantageous provisions in force in France and Europe, which make mandatory the right of withdrawal / money back guarantee, we are committed to respecting this law and make it available to all our international Customers. Thus, the latter may return one, several or all products of their order to request a refund. This right can be exercised without having to provide any reason - Article L.221-18 of the French Consumer Code.
The law gives the Customers a maximum of 14 days from the date of receipt of the items to notify the company that he or she is exercising the right of withdrawal - Article L.221-21 of the French Consumer Code. But our service prefers to offer Customers a more advantageous term, increasing the period from 14 calendar days to 30 calendar days (60 days during the Christmas period).
Note : this right of withdrawal can also be exercised during the delivery period.
If the Customer does not respect the deadline, Awakning Jewelry will not be able to refund the Customer.
9.2 LEGAL CONDITIONS OF WITHDRAWAL
To be eligible for the money back guarantee, the products must be returned to us, with their boxes, all in perfect condition. It must be like new and able to be resold. Because, any sign of use will lead to a reduction in the value of the article, which can then be resold as a second hand product - Article L.221-23 of the French Consumer Code. In this case, the refund may be canceled or partially executed.
Thus, the products must be returned to us for an estimate of its status to determine whether the refund will be full or partial.
In order to prevent the Customer from being held responsible for any damage in transit to our return address, we advise our Customers to take photos/videos of the items, their boxes and the package before shipping it.
Any return made by the Customer must be previously agreed with Customer Service.
9.3 RETURN TERM
Once Awakning Jewelry has accepted the return, it will inform the Customer. The latter must send us the product(s) within 14 days - Article L.221-23 of the French Consumer Code.
9.4 RETURN SHIPPING COST
The return shipping costs remain the responsibility of the Customer, who is also free to choose the shipping method - Article L.221-23 of the French Consumer Code.
9.5 RIGHT OF WITHDRAWAL PROCEDURE

9.6 RETURN PROCEDURE
Reminder: Any return made by the Customer must be previously agreed in advance with the Customer Service.
For any return, Customer must provide the order number with the affected item(s). The best option is to provide the order receipt with the item(s). If the Customer is unable to provide this receipt, Awakning Jewelry will accept any other document or personal note that clearly mentions the order number. The Customer is informed that the use of the mentioned document is essential for the return procedure by Awakning Jewelry.
The Customer is required to respect the same standards of packaging for the return as those used for the shipment.
In all cases, the return is at Customer's risk. It will be the responsibility of the Customer to retain any proof of return.

9.8 REFUND OF THE ORDER
The refund of the product(s) concerned will be made by the same means of payment as that used by the Customer for the initial transaction, unless otherwise specified by the Customer who would request a store credit, valid for one (1) year from its issue - Article L.221-24 French Consumer Code.
The refund is made as soon as possible and, at the latest, within 14 days following the reception of all the order's items. If the fourteen (14) days period expires on a Saturday, Sunday, holiday or non-business day, it is extended until the next business day.
9.9 PENALTY FOR LATE REFUND
If Awakning Jewelry does not reimburse the Customer within 14 days, the company will have to pay penalties to its Customer - Article L.242-4 of the French Consumer Code. The initial amount paid by the Customer will automatically be increased, following this conditions:
- by 5% if the delay is between 10 and 20 days
- 10% if the delay is between 20 and 30 days
- 20% if the delay is between 30 and 60 days
- 50% between 60 and 90 days and five additional points per new month of delay up to the price of the product, then the legal interest rate.
9.10 EXTENSION TO EXCHANGE
We have decided to extend the money back guarantee to offer our Customers the possibility to exchange their item once if it does not suit them or if they ordered the wrong product and want another model. This guarantee extension is not mandatory, it is an initiative of ours.
This warranty is available for 30 days year round and 60 days during the Christmas season.
The item to be returned and its box must be in perfect condition for the Customer to benefit from this right to error. Likewise, return shipping costs are the responsibility of the Customer. The shipping costs of the new shipment will be paid by Awakning Jewelry in the limit of an exchange. If the Customer makes a new mistake and requests an exchange again, any new shipment will be at the Customer's expense. In all transparency, these charges are available to the Customer from the shipping charges table presented in the answer to the "How much does shipping cost?" of our FAQ.

ARTICLE 10 : LEGAL GUARANTEE OF CONFORMITY
10.1 DESCRIPTION OF THE GUARANTEE
In accordance with the provisions in force in France and Europe, any item purchase must be in conformity with the expected use and the seller's description. The Customer has a period of 2 years from the delivery of the product to contact Awakning, to ask for a replacement and don't have to prove that the defect of the Product existed at the time it was delivered. This guarantee is called Legal Guarantee of Conformity and we undertake to make all our international Customers benefit from this law - article L.217-4 to L.217-12 of the French consumer Code.
Note : French and European laws provide that the Customer has the choice between repairing the defective item or replacing it. As Awakning does not offer a repair service, only replacement is possible.
10.2 CASES OF APPLICATION
The seller must deliver a good in conformity with the contract. He or she is responsible for conformity defects existing at the time of the delivery of the good.
To be recognized as non-conforming, the Customer's product must meet one of the following points:
- the goods do not conform to the usual use of goods of the same type
- the goods do not correspond to the description given by the seller
- the goods do not have the qualities detailed in an advertisement or in its labeling
- the goods do not correspond to the special use that the user is looking for, contrary to what the seller says
- the goods have a manufacturing defect, an imperfection, a bad assembly
More simply, if the product does not correspond to what is presented by Awakning, to what is described in the order, to the intended use, to the expected quality, it can possibly be considered as non-compliant and benefit from the legal guarantee of conformity.
10.3 CASES OF EXCLUSION
In order to benefit from the Legal Guarantee of Conformity, the product must have been used in accordance with its intended use, not in an excessive or inappropriate manner. The purchaser may not invoke this guarantee if it is at the origin of the defect of the article resulting from manipulations other than those necessary to establish the nature, characteristics and, where applicable, the proper functioning of the article L.221-23 of the French Consumer Code.
In addition, the Customer cannot invoke the legal guarantee of conformity in the following three situations as set out in article L. 217-8 of the French consumer Code:
- when he or she was aware of the defect at the time of entering into the contract;
- when he or she could not have been unaware of the defect at the time the contract was concluded;
- when the defect is the result of materials he or she has supplied himself or herself.
10.4 LIMITATIONS
Awakning jewelry has made the choice not to have a repair service for the moment. This decision was taken in accordance with article L. 217-9 of the French consumer Code, which allows us to avoid disproportionate costs that in our case would be reflected in the price of our jewelry. Thus, any request for repair will be considered as a request for replacement.
If Awakning Jewelry is not able to replace the item, the Customer will be refunded the price of the item and its possible shipping and customs charges. More information about refund in article 10.10 Potential Refund of the Order.
When Awakning Jewelry is in possession of an element that attests that the defect could not have existed at the time of delivery, the company will remind the Customer of its existence in order to prove the ineligibility for the legal guarantee of conformity.
10.5 PROCEDURE LEGAL GUARANTEE OF CONFORMITY
In order to assert his right for this guarantee, the Customer must send his request to the Customer service. The Customer must provide in its request the following elements:
- His order number
- Mentions that he/she wants to make use of the legal guarantee of conformity
- The name of the product concerned
Awakning Jewelry will process the request as quickly as possible. Please note that in order to ensure that the product is eligible for the legal guarantee of conformity, the company may ask you to provide photos/videos of the item.
If the Customer's request is made less than 30 days after delivery (60 days during the Christmas season), the company will send a new product without waiting for the non-compliant product to be returned.
If the time limit has been exceeded, a new product can only be sent after the item in question has been received by our company to ensure that it is nonconforming.
Any shipment of a new product under this warranty will be the responsibility of the company.
10.6 RETURN DELAY
We recommend that our Customer return the affected item within 14 days of return approval. The sooner the product is received, the sooner Awakning will ship a new product.
10.7 RETURN SHIPPING COST
Return shipping costs remain the responsibility of Awakning Jewelry. The Customer will have to anticipate them, transmit a proof of the expenses he/she has exactly paid to Awakning in order to be reimbursed. However, the amount will be limited to a maximum amount corresponding to the standard cost of a similar package tracked by mail.
10.8 RETURN PROCEDURE
Reminder: Any return made by the Customer must be agreed upon in advance with the Customer Service.
For each return, the Customer must simply provide the order number with the item(s) involved. The best option is to provide the order receipt with the item(s). If Customer is unable to provide this receipt, Awakning Jewelry will accept any other document or personal note that clearly mentions the order number. The Customer is informed that the use of the mentioned document is essential for the return procedure by Awakning Jewelry.

10.10 POTENTIAL REFUND OF THE ORDER
If a product is out of stock or no longer for sale, replacement will be impossible. In this case, the product and any shipping and customs charges will be refunded to the Customer. However, the Customer will have to provide proof of the customs charges he/she has incurred if he/she wants to be reimbursed for these expenses.
Refund will be made by the same means of payment used by the Customer for the initial transaction, unless otherwise specified by the Customer who has requested a store credit, valid for one (1) year from its issuance.
The refund will be made as soon as possible and no later than fourteen (14) days. If the fourteen (14) day period expires on a Saturday, Sunday, holiday or non-business day, it will extend to the next business day.
10.11 PENALTY FOR LATE REFUND
If Awakning Jewelry does not refund the Customer within 14 days, the company will have to pay penalties to its Customer - Article L.242-4 of the French Consumer Code. The initial amount paid by the Customer will automatically be increased, following this conditions:
- by 5% if the delay is between 10 and 20 days
- 10% if the delay is between 20 and 30 days
- 20% if the delay is between 30 and 60 days
- 50% between 60 and 90 days and five additional points per new month of delay up to the price of the product, then the legal interest rate.
10.12 CUMULATION OF GUARANTEES AND RIGHTS
The legal guarantee of conformity applies independently of any commercial warranty or guarantee related to hidden defects potentially agreed.
In addition, these provisions do not deny the Customer the benefit of his right of withdrawal as provided in Article 9 : Money Back Guarantee / Right of Withdrawal.
ARTICLE 11 : GUARANTEE RELATED TO HIDDEN DEFECTS
11.1 DESCRIPTION OF THE GUARANTEE
In accordance with the provisions in force in France and Europe, each item purchased must be free of non-visible defects. The Customer has a period of 5 years from the day of the order (that we prefer to consider from the day of delivery of the product, which is advantageous for our customers), and 2 years after the discovery of the defect to contact Awakning in order to ask for a total or partial reimbursement of the product accompanied by proof that the defect must have existed at the time of purchase. This guarantee is called Guarantee Related to Hidden Defects and we commit ourselves to make all our international Customers benefit from this law - articles 1641 to 1648 of the French Civil Code.
11.2 CASES OF APPLICATION
The product has a hidden defect which makes it unsuitable for use or which diminishes its use to such an extent that the Consumer would not have purchased it, or would only have paid a lower price for it, had he been aware of it.
11.3 CUSTOMER RIGHTS
If the Product has a hidden defect, the Customer may choose to either return the Product to Awakning Jewelry and obtain a refund of the price and expenses occasioned by the sale (such as shipping and customs charges), or retain it and obtain a reduction of part of the price - article 1644 French Civil Code.
An action under the guarantee against hidden defects must be brought within five (5) years from delivery of the product, and within the limit of two (2) years from discovery of the defect - article 110-4 of the French Commercial Code, article 2224 of the French Civil Code, article 1648 of the French Civil Code.
11.4 CONDITION OF APPLICATION
It is up to the Customer to prove the existence of a hidden defect that may have existed at the time of purchase. For this purpose, the Customer may produce the various repair certificates or repair estimates.
The Customer can also ask for a friendly expertise.
Please note that Awakning Jewelry does not issue refunds for repairs paid for by Customer.
11.5 PROCEDURE GUARANTEE RELATED TO HIDDEN DEFECTS
In order to assert its right to this warranty, the Customer must send its request to Customer service. The Customer must provide the following elements in his request:
- His order number
- Mentions that he/she wants to make use of the guarantee related to hidden defects
- The name of the affected product
- Photo(s)/video(s) of the product concerned
- Proof that the product was affected by the said hidden defect on the day of the sale
- His choice of a partial or total refund
Awakning Jewelry will process the request as soon as possible. The company will make an initial inspection of the product through photo(s)/video(s) to ensure that the defect may be covered by the guarantee related to hidden defects.
If the Customer requests a partial refund, the cost of the refund will be determined by Awakning through the photo(s)/video(s) provided by the Customer and the company will refund the Customer as soon as possible, within 14 days.
If the Customer has requested a full refund, the Customer will be asked to return the product for a second inspection necessary to determine the defect. If the defect is proven, Awakning will proceed as soon as possible with a full refund to the Customer within the 14-day limit.
11.6 RETURN DELAY
We recommend that our Customers return the defective item within 14 days of our return approval. The sooner the product is received, the sooner Awakning will proceed with the second inspection and the sooner the Customer will be refunded.

11.10 REFUND OF THE ORDER
If a full refund has been requested, the product and any shipping and customs charges will be refunded to the Customer. However, the Customer will need to provide proof of the customs charges he/she has incurred if he/she wish to be reimbursed for these charges.
If the refund requested is partial, only the product will be concerned by a refund.

11.11 PENALTY FOR LATE REFUND
If Awakning Jewelry does not reimburse the Customer within 14 days, the company will have to pay penalties to its Customer - Article L.242-4 of the French Consumer Code. The initial amount paid by the Customer will be automatically increased, according to these conditions:
- by 5% if the delay is between 10 and 20 days
- 10% if the delay is between 20 and 30 days
- 20% if the delay is between 30 and 60 days
- 50% between 60 and 90 days and five additional points per new month of delay up to the price of the product, then the legal interest rate.
11.12 CUMULATION OF GUARANTEES AND RIGHTS

ARTICLE 12 : REMINDER OF REGULATIONS

ARTICLE 13 : LIABILITY & FORCE MAJEURE
Awakning Jewelry cannot be held liable in case of non-performance or improper performance of the contract due to the Customer or due to an unforeseeable and insurmountable factor in connection with a third party to the contract or in case of force majeure.
We shall not be liable for non-performance or delay in performance of any of our obligations when such non-performance is due to a situation of force majeure, i.e. - and without the following list being in any way exhaustive - in the event of fire, hail, natural disaster, strike, maritime or river transport accidents or mail transportation of any other kind.
In the event of a force majeure, our contractual obligations will be maintained for the duration of the force majeure, but our terms of performance will be extended for a period of time equivalent to the duration of the force majeure, as applicable. Awakning Jewelry reserves the right to make any decision at any time depending on the evolution of the situation, including canceling the order, making another shipment, contacting a third party to unblock the situation, etc.
ARTICLE 14 : COMPLETENESS OF CONDITIONS
A change in legislation, regulation or court decision rendering one or more clauses of these General Conditions of Sale invalid will not affect the general validity of these Conditions. Such a change can in no way make it possible for the Customer not to comply with these General Conditions.
According to the laws in force in France, if a condition is not explicitly mentioned, it will be considered to be in accordance with the customs of the mail order industry by companies based in France.
ARTICLE 15 : INTELLECTUAL PROPERTY
The Website, as well as all rights thereto, are the property of Awakning Jewelry. All elements of the Site are protected by intellectual property rights, trademarks or patents. They are the exclusive property of Awakning Jewelry. Therefore, they cannot be reproduced, employed or used in any way.
ARTICLE 16 : APPLICABLE LAW AND JURISDICTION
The Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of France, and Customer irrevocably agrees that the French courts shall have exclusive jurisdiction in relation to any claim brought by Customer against the Company, but Awakning Jewelry shall be entitled to bring a claim against Customer in any court of competent jurisdiction.
ARTICLE 17 : MEDIATION, CLAIM & DISPUTE
In the event of complaint or dispute, it is agreed to seek an amicable solution before any legal action by contacting the Customer Service or by email to contact@awakningjewelry.com.
It is specified that Awakning Jewelry adheres to the Code of Ethics of the FEVAD (“Fédération du E-Commerce et de la Vente A Distance”/"Federation of E-Commerce and Distance Selling") and to the e-Commerce Mediation system of this federation. The Customer can therefore contact the FEVAD mediation service by clicking on this link http://www.mediateurfevad.fr/index.php/contact/ (French website).
In addition, in accordance with article L.616-2 of the French Consumer Code, Awakning Jewelry informs the Customer of the existence of the platform published online by the European Commission which aims to collect claims from any purchase of European consumers online and then forward the cases to the competent national ombudsmen. All disputes arising out of or in connection with this contract shall be finally settled in accordance with the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with said Rules.
If the two parties decide not to resort to arbitration, the dispute shall first be brought before the Commercial Court of Versailles (France) or the Commercial Court of Paris (France), and the applicable law shall be French law. However, Awakning Jewelry reserves the right to bring the dispute before the courts of the Buyer's place of residence, in which case the applicable law shall be that of the debtor's country, or a neutral law, i.e. Swiss law.
